Terms of sale

1. Purpose

These General Terms and Conditions of Use and Sale ("GTC") define the rights and obligations of MAISON CRIVELLI and consumers wishing to purchase products offered for sale on www.maisoncrivelli.com. Any order placed on the Site constitutes full acceptance of these GTC. The applicable version is the one in force on the date of the order.

2. Product Characteristics

The main characteristics of the Products, including specifications, illustrations and dimensions, are presented on the Site. Products comply with applicable cosmetic and home-fragrance regulations. Color differences may occur due to screen settings and do not affect the essential characteristics of the Products.

3. Account Creation

Creating an account is required to benefit from certain private offers and promotions. By creating an account, the Customer confirms that the information provided is accurate and accepts the data protection provisions described in these GTC. Login is performed using an email address and verification code. Account credentials are personal and confidential.

4. Orders

The ordering process includes product selection, cart validation, identification, payment method selection and final confirmation. The Customer may review and correct the order before confirmation. MAISON CRIVELLI reserves the right to refuse or cancel an order in the event of suspected fraud, payment disputes, or unusually large quantities exceeding normal consumer purchases.

4.3 Product Availability

Products are offered subject to availability. If an ordered Product becomes unavailable after an order is placed, MAISON CRIVELLI will inform the Customer as soon as possible and refund any sums paid within thirty (30) business days using the original payment method.

5. Prices

Prices displayed on the Site are in euros, inclusive of all taxes, and exclude shipping, transport and delivery charges unless otherwise stated. Prices may differ from those charged in physical stores. MAISON CRIVELLI reserves the right to modify prices at any time; however, changes will not affect orders already confirmed.

6. Payment

Payment in full is due when the order is placed. Accepted payment methods include eligible bank cards and PayPal. Transactions are processed through secure payment providers. MAISON CRIVELLI may verify customer information for certain purchases. Cash-on-delivery payments are not accepted.

7. Delivery

7.1 Delivery Terms

Products purchased on the maisoncrivelli.com website can only be delivered to the following territories: member states of the European Union, Monaco, Albania, Serbia, Andorra, Guernsey, Jersey, Liechtenstein, San Marino, Switzerland, Malta, Norway, Malaysia, Singapore, Saudi Arabia, Bahrain, Oman, and the United Arab Emirates.

This list may be amended by Maison Crivelli at any time; the countries eligible for delivery will be listed on the website at the time the Customer places their order.

It is not possible to place an order for any delivery address located outside these territories.

MAISON CRIVELLI delivers its Products using the following carriers: Colissimo, Chronopost, Chronopost Express, DHL, DHL Connect, and FedEx.

Unfortunately, delivery of the following products cannot always be guaranteed to all eligible countries due to the shipping rates applied by carriers:

  • Extrait de Parfum Discovery Set

  • Eau de Parfum Discovery Set

  • 5ml Extrait de Parfum formats

Products purchased on the Website will be delivered in accordance with the shipping times indicated at the time of order and to the postal address provided by the Customer when placing the order.

Maison Crivelli shall not be held liable under any circumstances for delays attributable to the Customer, including but not limited to the absence of the recipient at the time of delivery or an error made by the Customer when entering their details during the ordering process.

Delivery times indicated on the Website are provided for informational purposes only.

Orders will always be refused if the delivery address provided at the time of the order corresponds to:

  • a post office box;

  • a non-permanent or mobile address (mobile homes, caravans, campsites, or any other temporary accommodation that does not allow for secure hand delivery);

  • or a collective location (such as a hotel) where an individual address cannot be clearly and permanently assigned to a natural or legal person.

Maison Crivelli reserves the right to cancel any order that does not comply with these rules.

MAISON CRIVELLI undertakes to use its best efforts to deliver the Products ordered by the Customer within the indicated timeframes, following validation of the order and subject to receipt of payment.

MAISON CRIVELLI undertakes to keep the Customer informed by email of the progress of the processing of their order.

In the event of a delay in the delivery of the order, the Customer may, after a first formal notice that remains unsuccessful, terminate the contract in accordance with Article L.216-6 of the French Consumer Code. In this case, Maison Crivelli will reimburse the Customer for all sums paid no later than in accordance with the conditions set out in Article 10.

MAISON CRIVELLI cannot be held liable for consequences arising from delivery delays that are beyond its control or due to a force majeure event.

7.2 Receipt and Inspection

Customers must inspect parcels and products upon delivery. Any visible anomaly, damage, missing item or non-conformity must be reported promptly and, where applicable, noted on the carrier's delivery receipt. Supporting photographs and evidence may be required.

7.3 Delivery Claims

Claims relating to missing, damaged or non-conforming products must be submitted with supporting evidence. MAISON CRIVELLI reserves the right to request additional information and to reject fraudulent claims.

8. Transfer of Ownership and Risk

Ownership of Products remains with MAISON CRIVELLI until full payment has been received. Risk of loss or damage transfers to the consumer when the Products are physically received by the consumer or a designated third party.

9. Right of Withdrawal

Consumers have fourteen (14) days from receipt of the Product(s) to exercise their statutory right of withdrawal without giving reasons. Return shipping costs remain the responsibility of the Customer. Notice of withdrawal must be sent to Customer Service.

10. Returns and Refunds

Return requests must be made within fourteen (14) days of receipt. Products must be returned unused, in new condition, in their original packaging and sealed where applicable. Refunds will be issued through the original payment method.

Returns are currently not accepted from Hong Kong, India, Malaysia, Singapore, Bahrain and Oman.

11. Warranties and Liability

Consumers benefit from the legal warranty of conformity and the warranty against hidden defects under French law. Depending on the circumstances, consumers may obtain repair, replacement, price reduction or reimbursement. MAISON CRIVELLI also maintains quality-control procedures but cannot be held liable for improper storage or misuse of products.

12. Intellectual Property

All content on the Site, including photographs, videos, trademarks, packaging, designs and other intellectual property rights, is the exclusive property of MAISON CRIVELLI. Reproduction or commercial use without prior written authorization is prohibited.

13. Personal Data

Personal data is processed in accordance with the GDPR and applicable French law. Customers have rights of access, rectification, erasure, restriction, objection and portability. MAISON CRIVELLI may use cookies and tracking technologies to improve the Site. Complaints may be submitted to the CNIL.

14. Force Majeure

Neither party shall be liable for failure or delay in performance caused by a force majeure event within the meaning of Article 1218 of the French Civil Code. Obligations are suspended for the duration of the event.

15. General Provisions

If any provision is declared invalid, the remaining provisions shall remain in force. These GTC are governed by French law. Consumers may use a consumer mediator before bringing legal proceedings. The competent mediator is MCP Médiation. Unresolved disputes are subject to the jurisdiction of the competent French courts.
